This Privacy Policy describes how ikioo Technologies, Inc. ("ikioo"), treats personal information when you use ikioo Remote Health Monitoring and Management Application, the ikioo Website and all related products and services (collectively, the "Service"). ikioo is located at 191 S Buena Vista St #370, Burbank, CA 91505 . All references to ikioo include its subsidiaries or affiliates involved in providing the Service. All references to you include your Proxy (defined below), if any.

  3. Definitions
    • Activity Logs.

    Activity logs are ikioo’s and its Vendors' records of when PHR Data is created, accessed, modified, deleted, released, or exported in the PHR program.

    • Aggregate Data.

    Aggregate Data is PHR Data that is: (1) grouped so it does not connect to you as an individual and (2) has names and other identifiers removed or altered. In other words, Aggregate Data is de-identified data.

    • Authorized Individuals.

    An Authorized Individual is someone you authorize to access your ikioo PHR on your behalf.

    A Dependent is a minor child or other individual over which a Proxy has legal authority. 

    "PHR" stands for a web-based Personal Health Record. A PHR is an electronic health data application that can help you collect, manage, and share your health information. The ikioo PHR is a PHR.

    • PHR Data.

    When you sign up for ikioo PHR, you have the option to provide and/or you authorize all or some of your Providers to provide to the ikioo PHR information about you that becomes the PHR Data.  Any information in the ikioo PHR is considered PHR Data.  PHR Data might include, but is not limited to:

    • Your name and contact information, such as your address, phone number, or email address
    • Your medical history, conditions, treatments, and medications
    • Demographic information, such as your age, gender, ethnicity, and occupation
    • Your exercise and food history
    • Information about your mobile device

    As described further below, ikioo may use your PHR Data to:

    • Operate and manage the Service;
    • Maintain and protect its computer systems
    • Comply with the law, such as responding to subpoenas and search warrants

    PHR Data includes Personal Information and Aggregate Data.

    • Personal Information.

    Personal Information includes your PHR Data, as well as any other information about you that reasonably can be linked to you such as name, health condition and other identifiers. 

    • Provider.

    Each care provider that you authorize to provide information to, and receive information from, your ikioo PHR and who pays for the Service.

    • Proxy. A Proxy is any individual who is your parent, guardian or someone else who otherwise has legal authority to provide information on your behalf and who has authorized and/or has access to an account with ikioo in the name of a Dependent.

    ikioo and its Service Providers might report about their business activities and their customers (you) to others, such as investors, auditors, potential business partners, or public communities.

    • Security Measures.

    Security measures can include computer safeguards, secured files, and employee security training. PHR companies may be required by law to notify you about particular data breaches.

    • U.S. Only.

    When PHR Data is stored in the United States, U.S. law enforcement agencies may be able to prosecute if the data is stolen or breached.

    A Vendor is an entity that is hired to perform certain functions for and operate on behalf of ikioo. Vendors may include software or website designers and data storage providers.

    • Vendors.

    A Vendor is an entity that is hired to perform certain functions for and operate on behalf of ikioo. Vendors may include software or website designers and data storage providers.

     

  4. What Information ikioo Collects
    1. Before you register for the Service, ikioo may collect information about you from your care Providers who pay to offer you use of the Service. ikioo will use such information for the sole purpose of informing you about the Service and inviting you to register for the Service.
    2. To use the Service, you must complete the registration process. As part of the registration process, you may be asked to provide certain information, such as your name, mailing address, email address, etc. You also may be asked to confirm all information, if any, that you or your care Providers have provided to ikioo prior to registration. Further, to register, you must agree to the Terms of Use. As part of the registration process, you also will be given the opportunity to provide additional information to ikioo, such as information regarding your health plan, home telephone number, etc. We recommend that you provide such information, as it will enhance your use of the Service.
    3. In general, ikioo collects all information that you supply directly to the Service. ikioo also may collect information from your care Providers who you expressly authorize to use the Service with respect to you and your information (each, a "Provider" and collectively, the "Providers"). By authorizing a Provider to access your ikioo account, you also authorize ikioo to collect information regarding you from your Provider's support staff and from others affiliated with your Provider or in your Provider's practice. Further, ikioo may collect information from other third party information providers that you expressly authorize (e.g., the Google Health Personal Health Record system, your fitness and/or weight management applications).
    4. Additionally, ikioo passively collects information regarding your location, and information regarding the last two to three websites or applications you use and/or visit prior to concurrently, and/or shortly after using the Service.  Ikioo may use this information for its internal business purposes, to provide you with the Services and to provide you with advertising and information regarding products which we may think will be of interest to you.
    5. In addition, ikioo passively collects information from you as you navigate through our Service. ikioo may track IP addresses, use industry standard tracking devices (e.g., session and persistent cookies, flash cookies, web beacons) and automatically gather information about the technology you use to access the Service and the areas of the Service you utilize. ikioo passively collects this information for operational purposes such as evaluating, updating and improving the Service.

     

  5. How ikioo Uses Your Information
    1. ikioo uses your information to provide the Service as described on the web site and Terms of Use as well as to enhance the performance of the Service and/or create new services. Your information also may be used to provide you with targeted advertisements, promotions and educational materials.
    2. ikioo may use your information to provide the Service in many ways. For example, if you choose to authorize a Provider to participate in the Service with you, then ikioo may use your information to facilitate the exchange of information and communication between you and your Provider (e.g., the Service would enable you to schedule an appointment with your Provider and receive an appointment reminder in return). The Provider also could, for example, use your information to update or modify your ikioo PHR, your health record in that Provider's electronic medical records, and send information to you as required by law.
    3. Communications between you and your Provider may be initiated by you, your Provider, or your Provider's permitted users. You are under no obligation to initiate or respond to such communications. By participating in such communications, you agree that your PHR Data contained in the ikioo PHR may be sent to your Provider and your Provider's permitted users through the Service. ikioo will not alter the content of the communications. However, ikioo may remove or block any content that ikioo deems offensive, indecent, or otherwise objectionable. ikioo may keep a record of all communications between you, your Providers and your Providers' permitted users. ikioo will not share the content of such communications except as permitted under this agreement or as required by law, unless you expressly consent to other disclosure.
    4. As noted above, to use the Service, you must complete the registration process. When you register for the Service and create an account, ikioo asks for your email address and a password, which is used to protect your account from unauthorized access.
    5. ikioo will not sell, rent, or share your Personal Information without your explicit consent, except as described in this agreement or when ikioo believes it is required to do so by law.
    6. If you elect to utilize any billing services features of the Service, ikioo also may use your information to process payments, send invoices and conduct other billing-related activities as requested by you.

     

  6. Sharing Your Information With Third Parties
    1. ikioo may make your Personal Information available to third parties participating in the Service that are authorized by you or as necessary to complete transactions you authorize.
    2. ikioo may disclose your Personal Information to ikioo’s Vendors that provide technical support or other services to ikioo related to the Service. All such Vendors are subject to confidentiality obligations and may only access and utilize your data for purposes of fulfilling their obligations to ikioo.
    3. ikioo may provide or sell Aggregate Data, including but not limited to aggregate statistics and blinded data about you, other users, participating healthcare providers, online traffic patterns and related information to third parties. However, Aggregate Data will not include any of your Personal Information.
    4. If a third party acquires the assets of ikioo related to the Service and its products and services (whether by sale, merger, change of control, bankruptcy or otherwise), your Personal Information may be transferred to the new owner(s). In such case, your Personal Information would remain subject to the provisions of the ikioo privacy policy that was in effect immediately prior to the transfer unless ikioo provides you notice otherwise.
    5. Some of the third parties mentioned in the preceding paragraphs may be covered by federal and state health privacy laws (such as the Health Insurance Portability and Accountability Act, or "HIPAA"), and those laws will govern how they may use and share your information. When you authorize ikioo to send your health information to others, you also will be giving ikioo permission to send all information retained by ikioo, including any Personal Information maintained by ikioo.

     

  7. Choices You Have About How ikioo Uses Your Information
    1. Managing Your Account. You have the following choices regarding the Personal Information you provide to ikioo for use:

      Generally, you may change how your information is used and disclosed through the account setting and account management features. Please note: As explained more fully in the Terms of Use, if you enter new data into the Service or use the Service to modify data obtained from third party sources, you should assume those updates and modifications will not be transmitted back to the third party sources. Thus, to implement such updates and modifications into the health records maintained by your Providers or other third party sources, you will need to contact your Providers and other third party sources directly and request implementation of such updates and modifications.

      You also may opt out of receiving communications from ikioo or with regard to the Service by changing your account settings or, if the account settings feature is unavailable, by notifying ikioo at [insert].

      If you do not wish ikioo to collect cookies, you may set your browser to refuse cookies, or to alert you when cookies are being sent. If you do so, please note that some parts of the Service may then be inaccessible or may not function properly.

    2. Authorized Individuals. You may grant access to your ikioo account to one or more Authorized Individuals.  You may grant an Authorized Individual access to your ikioo account by specifically authorizing ikioo to permit access by such Authorized Individual to your ikioo account.  When you grant access to an Authorized Individual you determine the level of access you would like to provide the Authorized Individual.  For example, the Authorized Individual may be able to access your Digital Interactive Diary or your PHR.  Authorized Individual shall be authorized to access your ikioo record ONLY, and shall NOT be able to communicate with or otherwise engage in transactions with your Providers.  Only you will be able to establish or terminate connections with your Providers.  You acknowledge and agree that: (a) you are solely responsible for verifying the identity of, and monitoring the use by, any Authorized Individual you select; and (b) ikioo has no responsibility or liability in connection with any access to, or use of, your account and information by any Authorized Individual.
    3. Deactivating a Provider, Other Third-Party or Authorized Individual. You may deactivate any Provider's, other third-party's or Authorized Individual's right to communicate with you or access your Digital Interactive Diary or PHR through the Service by utilizing the account management tool of the Service. Once deactivated, the Provider, other third-party or Authorized Individual may no longer access and use the Service with respect to you and your Personal Information. However, copies of all of your Personal Information previously disclosed to such Provider, other third-party, or Authorized Individual and incorporated into such Provider's, other third-party's or Authorized Individual’s records may remain in such Provider's, other third-party's or Authorized Individual’s records. By using the Service, you agree that ikioo cannot, and has no obligation to, remove Personal Information from your Provider's, other third-party's or Authorized Individual’s records.
    4. Terminating Your Account. You may terminate your ikioo account at any time by notifying us at [insert]. In addition, except with respect to a Proxy who establishes an account on behalf of a Dependent, ikioo will terminate your account within thirty (30) days of its receipt of a death certificate certifying your death. With respect to a Proxy, ikioo will terminate all accounts associated with such Proxy within thirty (30) days of its receipt of a death certificate certifying the death of such Proxy unless a Dependent also has a living Proxy associated with the account.  Otherwise, ikioo will maintain and/or destroy all data associated with your account in accordance with its then current document retention and destruction policies. Please note that copies of your Personal Information may remain in your Providers', other third-parties' and Proxy's and/or Authorized Individual’s records. The above rules will apply if we terminate your account as permitted under the Terms of Use.

     

  8. Data from Children Under the Age of 18
  9. The Service is not intended for use by children under the age of 18. ikioo will not knowingly collect information from site visitors in this age group. However, parents or guardians may elect to establish ikioo PHR for their children through the Service as Proxies and, in doing so, expressly consent to ikioo utilizing such information as set forth in this Privacy Policy and the Terms of Use.

    A Proxy may authorize and/or have access to a PHR for a Dependent.  Through the account, the Proxy may be able to:  (a) review and update the Dependent’s personal health record as maintained on ikioo; (b) communicate with the Dependent’s Providers with regard to the Dependent’s health status and otherwise; and (c) engage in such transactions as permitted between the Proxy and the Dependent’s Providers through the ikioo PHR.  A Dependent’s ikioo account will be linked to a Proxy’s ikioo PHR account until the earlier of the date:  (i) the Dependent reaches the age of 18, or (ii) ikioo is notified by the Dependent’s Provider that the Dependent has been emancipated or otherwise attained legal custody of his or her own health information.  Each Proxy understands that a Dependent’s ikioo account also may be linked to the ikioo account of another Proxy, and each Proxy will have the same rights to access and communicate through the Dependent’s ikioo PHR account.  Each Proxy agrees that if he or she becomes aware of any change in any Proxy’s relationship to the Dependent that may result in the Proxy no longer qualifying as a Proxy, the Proxy will advise the Dependent’s Providers of the same.

     

  10. How ikioo Protects Your Information
    1. ikioo uses both technical and procedural Security Measures to maintain the integrity and security of the PHR and other databases, including the use of firewalls. The safety and security of your Personal Information also depends on you. If you have access to password-protected features, never share your password with anyone else, notify ikioo promptly if you believe your password security has been breached, and remember to log off of this application before you leave your device.
    2. This site may contain links to other web sites operated by third parties that may be of interest to you. ikioo cannot control these third party sites, which may collect Personal Information from you. When you follow a link and leave this site, you do so at your own risk.

     

  11. Security Breach Notification Requirements
  12. Pursuant to various state and federal laws, ikioo may be required to send you notice of security breaches or suspected security breaches that impact your Personal Information. ikioo will send you security breach notices to the e-mail address contained in your account information. Please note: many e-mail systems have built in SPAM filters. If you have one in place, you should check with your system administrator or the available instructions to confirm that e-mails from ikioo are not blocked by the filter (e.g., by confirming that the Service domain name (ikioo) is a permitted domain name.

     

  13. Changes to this Privacy Policy
  14. ikioo reserves the right to change the Privacy Policy in its sole discretion. In such case, ikioo will post the new Privacy Policy on the web site and the effective date of the new Privacy Policy will be clearly marked. Remember, by using any part of the Service, you accept and agree to our privacy practices. If ikioo updates this Privacy Policy, your continued use of the Service (following the posting of the revised Privacy Policy) means that you accept and agree to the terms of the revised Privacy Policy.
